Authority of the Bus Driver

TITLE V, CALIFORNIA CODE OF REGULATIONS SECTION 14103 STATES: AUTHORITY OF THE DRIVER: Pupils transported in a school bus or in a school pupil activity bus shall be under the authority of, and responsible directly to, the driver of the bus, and the driver shall be held responsible for the orderly conduct of the pupils while they are on the bus or being escorted across a street, highway or road. Continued disorderly conduct or persistent refusal to submit to the authority of the driver shall be sufficient reason for a pupil to be denied transportation. A bus driver shall not require any pupil to leave the bus enroute between home and school or other destinations. (b) Governing boards shall adopt rules to enforce this section. Such rules shall include, but not be limited to, specific administration procedures relating to suspension of riding privileges and shall be made available to parents, pupils, teachers, and other interested parties.

  1. Riders and their parents or guardians must agree to the Discipline Policy as outlined below. A parent/guardian will be required to agree to these rules during the registration process. Parent/guardian agreement in their registration submission will constitute an electronic signature and agreement for their student.
  2. The bus maintains a strict schedule. The driver will not open the doors for any rider at the bus stop or school once the doors have been closed in preparation for departure after the scheduled departure time.
  3. The Placer Bus Group does not provide supervision at the bus stops before or after bus departure.
  4.  General Rules of conduct on the bus:
    • Students must stand 12 feet from the bus and not walk toward the bus until the door opens.
    • All students are to be seated quickly and as instructed by the driver with no arguments.
    • Students must remain seated while the bus is in motion.
    • Students are not to reach out or lean out of the windows.
    • There shall be no eating, drinking or gum chewing on the bus.
    • Students will not throw objects in the bus or out of a window.
    • Students will refrain from excessive noise, rude, discourteous conduct, or other unacceptable behavior.
    • Each student is responsible for his/her own property. Students are not to engage in horseplay or touch another student's property without permission.
    • A student may take guests on the bus provided they complete the Occasional Rider Form. Please see the “Registration Policies” in the “Ridership Eligibility” section of this document.
  5. Violations:
    • Violation of any of the above rules or noncompliance of the bus driver’s orders may result in a verbal or written warning, a suspension, or expulsion from bus ridership depending on the severity and frequency of the violation(s).
    • In the event of a written warning or suspension, the Bus Driver will issue a written Incident Report, which will require both the student and parent/guardian to sign and return the Incident Report to the Bus Driver before being allowed to re-board the bus.
    • Appeals are only available for the expulsion of a rider from the bus and must be submitted in writing to the Placer Bus Group within 5 days of the termination of the student.

Discipline Policy Agreement and Medical Treatment Authorization Between Placer Bus Group and Participating Students and Parents/Guardians

Because passenger safety on the bus is imperative, everyone must accept the absolute authority of the bus driver over the students during the operation of the bus.

  1. The bus driver will issue a written Incident Report describing the student’s misconduct.
  2. The first and second offense may result in a warning or suspension from the bus for one or two full days.
  3. Each Incident Report must be signed by the parent or guardian and accepted/returned to the bus driver before the student can re-board the bus.
  4. Student refusal to accept the driver’s Incident Report will result in a five (5) day suspension for the offense. In such an event, the Incident Report will be sent by email to the parent or guardian.
  5. A third offense during a school year may result in expulsion from the bus group. Notification of this action will again be sent by email.
  6. The driver’s decision in issuing an Incident Report is final.
